Terms and Conditions
1. By completing the Members Application Form you confirm you have reviewed, understood and agree to the Blacklist Club Membership terms.
2. We reserve the right to change these terms from time to time, and you agree that each time you use the Blacklist Club Membership you accept the terms laid out at https://blacklist.memberjungle.com
3. Participation in the Blacklist Club Membership is open only to individuals (including employees of Blacklist Coffee Roasters). Participation is offered at the discretion of Blacklist Club Membership, who has the right to accept or reject any application to participate at its sole discretion.
4. Membership with Blacklist Club costs $120.00 a month and renewal is offered at the discretion of participants.
5. The Blacklist Club Membership virtual card can only be used upon physical presentation by the relevant Blacklist Club member.
6. The Blacklist Club Membership is only valid at Blacklist Coffee Subiaco (439D Hay Street, Subiaco, WA 6008) and is not valid with any other coupons, vouchers, discounts or in-store offers.
7. The Blacklist Club Membership allows the member:
(a) Unlimited coffee all day everyday, including drinks from the filter bar. Additional charges may apply for limited release single origins.
(b) Such other Blacklist Club Membership as listed on https://blacklist.memberjungle.com from time to time
8. The Blacklist Club Membership reserves the right to change the Blacklist Club Membership Benefits and terms anytime without notice. Terms will be updated on the website https://blacklist.memberjungle.com.
9. From time to time, Blacklist Club Membership may send you offers in conjunction with other loyalty programs operated within The Blacklist Membership Club stores.
10.From time to time Blacklist Club Membership may send you offers from Blacklist Coffee Roasters.
11. Each Blacklist Club Membership is valid for one person only and cannot be used by any person other than the Member whose name appears on the Blacklist Club Membership issued.
12. Blacklist Club Membership is not responsible for lost, damaged or stolen cards.
13. Membership may be cancelled/refused to individuals by Blacklist Club Membership at its discretion, if Membership is deemed to be fraudulent, linked to a fraudulent Membership and/or a Member engages at any Blacklist Club Membership Store and/or to a Blacklist Club Membership or The Blacklist Club Membership Store employee in a derogatory, harmful, drunken and/or manner otherwise regarded by Blacklist Club Membership as inappropriate.
14. Members are solely responsible for any government tax, duty or other charge imposed by law in any country in respect of The Blacklist Club Membership, your participation in The Blacklist Club Membership Program, The Blacklist Club Membership giveaways, prizes or vouchers issued or any other transaction within or resulting from The Blacklist Club Membership Program.
15. Any failure or delay by The Blacklist Club Membership in exercising its rights under these Terms does not constitute a waiver of those rights and any waiver by The Blacklist Club Membership must be in writing and signed by an authorised officer of The Blacklist Club Membership.
16. Except as provided in any law which cannot lawfully be excluded or modified by agreement, The Blacklist Club Membership does not accept any liability whatsoever, including for negligent acts and omissions, with respect to:
(a) the breach of any of these terms or any term implied by law (including statute) by any person other than The Blacklist Club Membership;
(b) any Blacklist Club Membership Benefit or other reward, prize or giveaway;
(c) any death or injury or consequential loss or damage arising from the supply of a Blacklist Club Membership Benefit and/or other reward, prize, giveaway;
(d) the loss, theft or destruction of a The Blacklist Club Membership Card or any other Blacklist Club Membership Benefit or other reward, prize, giveaway;
(e) any failure, delay or inability to provide a The Blacklist Club Membership Card or other Blacklist Club Membership Benefit or other reward, prize, giveaway to you caused by circumstances beyond its control, including strikes or industrial disputes, acts of God, flood, weather, war or civil disturbance; and
(f) any other liability, loss or damage incurred or suffered by any Member (or any other person) in connection with The Blacklist Club Membership.
17. The Blacklist Club Membership may give you notice:
(a) by email or sms (to the last known email address or mobile number provided), which you are taken to have received upon the sender receiving confirmation the message has been sent;
(b) by The Blacklist Club Membership website (https://blacklist.memberjungle.com), which you are taken to have received within 5 days of posting on the website; or
(c) in writing, which you are taken to have received if issued by hand, immediately, or given by post on the earlier of the date of receipt or 3 days after it was sent via post.
18.You must advise The Blacklist Club Membership of any change of name, address, or other details as soon as the change occurs. The Blacklist Club Membership is not responsible for any failure by you to notify The Blacklist Club Membership of the change that may result in the loss of The Blacklist Club Membership Benefits and/or any other rewards, prizes, giveaways. Written proof acceptable to The Blacklist Club Membership must be supplied for any change of details. Changes to address can be made by email to subi@blacklistcoffee.com.au or in writing to Blacklist Coffee Roasters 41 Welshpool Road, Welshpool 6106 WA.
19. These terms will be construed according to and governed by the laws of Western Australia and the parties submit to the exclusive jurisdiction of the courts in Western Australia.
20. You consent to us, our franchisees, licensees, and business partners contacting you from time to time, including via telephone, post, facsimile and electronic (i.e. sms, Internet) methods.
21. You agree that you have read and accept the terms of our privacy policy on https://blacklist.memberjungle.com/index.cfm?module=TERMS_AND_CONDITIONS including without limitation the collection, use and disclosure of personal information.
22. Definitions:
(a) Application Form means The Blacklist Club Membership Application Form required to be completed by the individual to become a member.
(b) Member means the person who is a member of The Blacklist Club Membership and whose name is printed on the Blacklist Club Membership Card.
(c) The Blacklist Club Membership Store means The Blacklist Coffee store, whether it be a franchise or corporately owned and/or operated.
(d) The Blacklist Club Membership means the loyalty program operated and managed by The Blacklist Club Membership by which a Member may receive the Blacklist Club Membership Benefits in accordance with these Terms.
(e) Blacklist Club Membership Benefits means the facilities, services, products, discounts, offers, activities and events or arrangements offered or available to Members from time to time.
(f) Blacklist Club Membership Card means The Blacklist Club Membership Card provided by The Blacklist Club Membership for use by each Member in relation to The Blacklist Club Membership Program.
(g) We/us/The Blacklist Club Membership is managed by Blacklist Coffee Roasters Pty Ltd ACN 169424319 ABN 16169424319
